Where children are involved legal separation, dissolution, and divorce all require that custody be addressed. Custody issues can also arise in other circumstances outside divorce proceedings.

Each case will be different. Custody issues will be decided based on a variety of factors. In the end custody will be awarded by the court to one parent or both, or to another legal guardian.

The difference between “sole custody” and “shared custody” has to do with the amount of decision-making each parent, or guardian, has regarding education, medical care, religious upbringing, etc.

The primary consideration in any custody case will be the welfare of the child. So, the court will attempt to make a determination that is in the best interest of the child.
