A will (or “testament”) is a legal and valid document, which is created while still alive and which provides instructions as to the disposition of an estate upon one’s passing.
If one dies without a will one dies intestate and runs the risk of having that estate disposed in a manner not of their own choosing. In this case the probate court would decide how the estate would be distributed, once claims against the estate have been settled.
It is important to have a valid will drawn up by a professional attorney in order to avoid any problems during the probate process.
